1. Definitions of Fraudulent Activity
"Fraudulent Activity" or "Artificial Streaming" includes, but is not limited to:
- Botting: Using automated scripts, bots, or software to play tracks on a loop.
- Click Farms: Employing groups of people to manually play tracks repeatedly.
- Impersonation: Uploading content that mimics popular artists to deceive listeners (e.g., "Fake Artists").
- Metadata Manipulation: Using misleading titles, artist names, or artwork to confuse search algorithms.
- Paid Placement Services: Paying third-party services that guarantee a specific number of streams or playlist placements (often achieved via bots).
2. Monitoring and Detection
We employ advanced proprietary algorithms and partner directly with Digital Service Providers (DSPs) like Spotify and Apple Music to detect anomalous listening patterns. Indicators include:
- Excessive streams from a single device or IP address.
- Abnormal loop rates (tracks played for exactly 30 seconds).
- Sudden spikes in streams with no corresponding social media growth or marketing activity.
3. Consequences of Violation
If we detect or suspect Fraudulent Activity associated with your account:
- Immediate Takedown: Your content will be removed from all DSPs immediately.
- Account Termination: Your SoundFlow account will be permanently banned.
- Royalty Forfeiture: Any accrued royalties will be frozen and forfeited.
- Clawbacks: If royalties have already been paid out for fraudulent streams, we reserve the right to recoup these funds from future earnings or legal action.
- Financial Penalties: You may be liable for fees imposed by DSPs (e.g., Spotify's penalty per fraudulent track).
4. Dispute Process
If you believe your content was flagged in error, you may submit a dispute within 14 days of the takedown notice. You must provide verifiable evidence of legitimate marketing and organic growth (e.g., ad campaign reports, social media analytics).
